These Terms of Service ("Terms") govern your use of the Veris Beauty store at https://verisskin.com (the "Site") and your purchases from it. The Site and the Veris Beauty brand are operated by Vitalise LLC, a Wyoming limited liability company ("we," "us," "our"). By using the Site or placing an order, you agree to these Terms, our Privacy Policy, Refund & Returns Policy, Shipping Policy, and (if you enroll) our Subscription & Auto-Renewal Terms, each incorporated by reference.
1. Eligibility
You must be at least 18 years old and able to form a binding contract to buy from us.
2. Products, orders, and pricing
We describe our products as accurately as we can, but colors, packaging, and details may vary. All prices are in U.S. dollars. We may correct errors, change prices, or limit or cancel quantities (including after an order is placed) and will refund you if we cancel an order you've paid for. Placing an order is an offer to buy; our acceptance occurs when we ship.
3. Guarantee and returns
Our 60-Day Naked-Eye Guarantee and return terms are described in our Refund & Returns Policy, which is part of these Terms.
4. Subscriptions
If you enroll in Subscribe & Save, our Subscription & Auto-Renewal Terms apply, including automatic recurring billing until you cancel and how to cancel online at any time.
5. Cosmetic products; no medical advice
Veris Beauty products are cosmetics, intended to improve the appearance of skin. They are not intended to diagnose, treat, cure, or prevent any disease and are not a substitute for professional medical advice. Individual results vary. Consult a qualified professional for any medical concern. Do not use if you are allergic to any ingredient; discontinue use and seek help if irritation occurs; for external use only; avoid contact with eyes.
6. Intellectual property
The Site and its content (text, images, logos, the Veris Beauty marks, and design) are owned by or licensed to Vitalise LLC and protected by law. We grant you a limited, personal, non-transferable license to use the Site to shop. Don't copy, scrape, or reuse our content without permission.
7. Acceptable use
Don't use the Site unlawfully, interfere with it, attempt unauthorized access, or misuse the guarantee or promotions. We may suspend access for misuse.
8. Email and SMS marketing
If you opt in, you consent to receive marketing messages. Email: unsubscribe anytime via the link in any email. SMS (separate opt-in only): reply STOP to cancel and HELP for help; message and data rates may apply; consent is not a condition of purchase.
9. Disclaimers of warranties
The Site and products are provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties not expressly stated here, including implied warranties of merchantability and fitness for a particular purpose. This does not limit the express promise in our 60-Day Naked-Eye Guarantee.
10. Limitation of liability
To the fullest extent allowed by law, Vitalise LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, and our total liability for any claim relating to a product or the Site will not exceed the amount you paid for the product at issue. Some states don't allow certain limitations, so some may not apply to you.
11. Indemnification
You agree to indemnify Vitalise LLC against claims and costs arising from your misuse of the Site or violation of these Terms.
12. Governing law
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules, except where a consumer-protection law of your home state provides rights that cannot be waived.
13. Dispute resolution — informal resolution, arbitration, and class-action waiver
- Informal resolution first. Before starting arbitration, contact us at legal@verisskin.com and give us 60 days to resolve the dispute.
- Binding arbitration. If we can't resolve it, you and Vitalise LLC agree to resolve disputes by binding individual arbitration administered by the American Arbitration Association (AAA) or JAMS under its consumer rules, rather than in court, except as noted below.
- Class-action waiver. You and we agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative action.
- Small-claims carve-out. Either party may bring an individual claim in small-claims court.
- Arbitration fees. For claims under $10,000, we will reimburse your arbitration filing fee, unless the arbitrator finds your claim frivolous.
- Opt-out. You may opt out of this arbitration agreement by emailing legal@verisskin.com within 30 days of first accepting these Terms.
14. Changes to these Terms
We may update these Terms; the updated version posts here with a new date and applies going forward.
